Since 1 April 2019, all letting agents in England who hold client money including landlord rents, tenant holding deposits, and security deposits are legally required to belong to a government-approved Client Money Protection (CMP) scheme. Failure to join can result in fines of up to £30,000 per offence. Failure to display your CMP membership certificate carries a further fine of up to £5,000.
CMP requirements have since been extended to Scotland and Wales. Six government-approved schemes are available, including Propertymark, RICS, Safeagent, Client Money Protect, Money Shield, and UKALA Client Money Protection. MTD for Income Tax
From April 2026, Making Tax Digital for Income Tax Self Assessment (MTD ITSA) becomes mandatory for self-employed individuals and landlords with gross income over £50,000. The threshold drops to £30,000 in April 2027 and is planned to fall to £20,000 thereafter. Is Client Money Protection mandatory for letting agents?
What is Making Tax Digital and when does it apply to my agency?
MTD for Income Tax Self Assessment becomes mandatory from April 2026 for sole traders and landlords with gross income exceeding £50,000. The threshold reduces to £30,000 in April 2027. Under MTD, quarterly digital submissions replace the single annual Self-Assessment return, and records must be maintained digitally using HMRC-approved software. If your agency is a limited company, you are subject to MTD for Corporation Tax under a separate, later rollout. We prepare clients for MTD well in advance of these deadlines.
Do letting agents charge VAT on their fees?
Letting agency services provided to landlords — including tenant-finding fees, management commissions, and renewal fees — are generally subject to standard-rate VAT at 20% for VAT-registered agents. The VAT threshold is currently £90,000 in annual turnover, above which registration is mandatory. Some ancillary services may attract different VAT treatment. We advise on the correct VAT classification of each income stream your agency operates to ensure both compliance and commercial competitiveness.
How should client money be separated from business funds?
Client money including rent received from tenants and held on behalf of landlords must be held in a dedicated client money bank account that is completely separate from your business operating account. The account must be held with a bank or building society authorised by the Financial Conduct Authority. The funds in a client account are not business assets and cannot be used to meet business expenses. Our bookkeeping systems ensure this separation is maintained cleanly and documented fully in your accounts.
